Terms and conditions

1. Acceptance of Terms
​
1.1 Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Website. Your access to and use of Room 100 Marketing Website or Services is subject (unless expressly stated otherwise) exclusively to these terms and conditions. You will not use the Website for any purpose that is unlawful or prohibited by these terms and conditions.

1.2 We reserve the right to change these terms and conditions without notice, and Users agree to be bound by such changes. It is the responsibility of Users to check these Terms and Conditions regularly for any changes.

1.3 If you are entering into these terms and conditions on behalf of your employer or acting as an employee, you warrant that you are authorised to enter into legally binding contracts on behalf of your employer. You further warrant that your employer agrees to be bound by these terms and conditions.

2. Prohibited use of the Site by Users
Users are expressly forbidden to download, store, reproduce, transmit, display (including without limitation via an intranet or extranet site), copy, sell publish, distribute, provide access to Content for any purposes other than as set out herein or to sub-license, rent, lease, transfer or assign any rights in Content, to any other person, commercially exploit or use Content for any unlawful purpose.

3. Price and payment
The price shall be that in the Seller’s current List Price, or such other price as the parties may agree in writing. The price is exclusive of taxes or any other applicable costs. Carriage shall be paid for by the Buyer.

4. Delivery
Unless otherwise agreed in writing, delivery of the Goods shall take place at the address specified by the Buyer on the date specified by the Seller. The Buyer shall make all arrangements necessary to take delivery of the Goods whenever they are tendered for delivery. The date of delivery specified by the Seller is an estimate only. Time for delivery shall not be of the essence of the contract and no liability will attach to late or postponed deliveries due to conditions beyond the reasonable control of the Seller.

5. *Cancellation or postponement
Deliveries in respect of orders for goods may only be postponed with the written agreement of the Seller. If the Buyer cancels an order the Seller will endeavour to find an alternative Buyer, but will be entitled to charge the Buyer for any losses suffered as a result of the cancellation.
Cancellation of order should be in time frame: No payment within 24 hours of cancellation; 50% within 5 working days; Full payment after 5 Working days.

6. Force majeure
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations. If the delay persists for such time as the Seller considers unreasonable, it may, without liability on its part, terminate the contract.

7. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the Law of India and the parties hereby submit to the exclusive jurisdiction of the Indian courts.

Returns Policy

Seller agrees to repair or replace (at Seller's option) all Products which fail to conform to the relevant order set within a week of the product received.

Notification of the defect is received by Seller within 2 working days of the delivery of product.

Allegedly defective Products are returned to Seller with Seller's prior authorisation within fifteen (15) days of the defect becoming apparent.

The Products have not been altered, modified or subject to misuse, incorrect installation, maintenance, neglect, accident or damage by excessive current or used with incompatible parts.

Once your order has passed the 3 days mark, this policy does not apply to your order any longer.

Your right to return products does not apply to goods made to your specification, that have been clearly personalised or have been cut to order (this is for fabric orders).
